Terms of Service:These Terms of Service are subject to revision without notice. The Client must read and understand the below terms before entering into a commission agreement with the Artist (Ginger Cooley).
By sending payment, the Client agrees to the following terms.
1. The Artist has the right to refuse any commission request.
2. The Artist reserves the right to issue a refund and cancel a commission due to poor communication, rude/inappropriate behavior, an inability to effectively communicate in the English language, or a breach of these Terms of Service.
3. The Artist will
not create any depiction of illegal activities, sexually explicit (x-rated) materials, or hateful/racist imagery.
4. The Artist will
not reproduce a copyrighted image or character without consent of its creator.
5. The Artist retains all rights to the commission, including the rights to distribution (i.e., to create prints, merchandise, etc.).
6. The Artist retains the right to display the commission on any personal-use website (e.g. portfolio, Facebook, blog, etc.) or online/offline art gallery. 6a. If the commission is time-sensitive, the Artist will delay public display of the art at the request of the Client.
7. The Client may
not re-distribute, reproduce, or otherwise profit from the commission, beyond the resale of the original, [traditional art] commission, or as it applies to the terms of service agreed upon in a
commercial purpose commission as described in Term 13.
8. The Artist is
not responsible for printing the [digital art] commission.
9. The Client may
not exhibit the Artist's commission in any commercial website (e.g., Tumblr, etc.) or personal-use website (e.g., Facebook, blog, etc.), nor may the Client display the work in any online/offline art gallery, without displaying the Artist's name and notifying the Artist, and the exhibit does not breach Term 7.
11. The Client is advised to specify the desired display size of the commission, whether digital art or traditional art. An excessively large display size may cost more; an excessively small display may cost less.
12. The Client may re-size/crop the commission to create icons, wallpapers, or other graphics to be used in
non-commercial digital format, as long as it does not breach Terms 7 or 9.
13. If the commission is for
commercial purposes, the Artist must be notified prior to the start of work. Commercial use of the commission will be decided upon on a case-by-case basis, and will result in an increased price. New terms of service must be written and agreed upon before the start of work.
14. I reserve the right to add additional charges if the characters are elaborate.
Required Client InformationBefore the Artist enters a commission agreement, the Client must produce the following information.The Artist will not share Client contact information.Email address: The Artist must have the Client's email address before entering into a commission agreement. This applies to all commission requests, even if the Client contacts the Artist via the DeviantART "Note" system (applies to DeviantART members only). The Client is encouraged to contact the Artist via email, but other means of Artist contact can be made available to the Client upon request.
The Client must make commission inquiries as specific as possible. Clear and concise visual references (if available) and/or detailed description of the commission must be provided by the Client to the Artist prior to the commission agreement. A) If you are requesting a portrait based on a picture, I ask that the picture you send be clear and of good composition. B) If you are requesting an original character please fill out this description form, and Email it with your request. C) Furry Portraits - Shoulder and up. Required: Reference Photos = animals it is based on + a reference image of the character) Note: I currently do humanoid furies, and not full on furies, and I only do things with fur and feathers, at the moment. Conditions:There will be a condition that you must agree to before you decide to commission me. I'd like the client to give me a certain amount of freedom. That means, I won't necessarily follow the character's color schema or background suggestions, though I may take it into consideration (usually based on what I feel would be the best combination for the picture).
The client will receive a sketch before I start painting, except on option 1 and 3, so changes can be made; then another half way through to assess and ask for changes. These will be the only time you will be able to make major changes to the image. At the end if there are a few small details I forgot, you can let me know so I can fix it, but no major changes.
Note: I must ask for your patience when you commission me due to personal issues, but once I get started it, it should be done within two to four week's time, generally for the more detailed images.
Also please make the description short, simple, and easy to understand.
Payment MethodAll prices are expressed in U.S. dollars, and payments are expected to be made as such. The Client is responsible for sending the correct amount, equal to the listed U.S. dollar amount.
Displayed base prices are subject to change according to the complexity, difficulty, size, and medium of each commission.The Artist requires full Commission Total for options 1 and 2. For Options 3, 4, and 5, 1/3 of the Commission Total or full payment up front before start of work. No exceptions, IOUs, art trades, etc. *
For those of you who want to do the $120 USD + $20 USD per hour option, you need to put a down payment of $120 USD down.If the Client wishes to cancel the commission after the commission agreement, but prior to start of work, the Client will be refunded 100% of the payment. No refund will be issued by the Artist to the Client after start of work.
Payment may be made to the Artist via PayPal services, and addressed to
eeddey@hotmail.com. Alternatively (applies to DeviantART members only), the Client may choose to pay for the commission via DeviantART's commission feature as displayed on the Artist's DeviantART portfolio, though this option may not always be open, so please check my profile page!!!
If the client is paying with PayPal then please email me your DeviantART username along with your PayPal email, so I know whose commission to start working on!
If the Client does not have PayPal or access to DeviantART's commission feature, other means of payment will be arranged; payment is still required up front, before start of work.
